American preacher wants court to order release of his items

NAIROBI, Kenya, AUGUST 26_ AN American Evangelist accused of possessing pornographic material yesterday urged a Kibera court to order police to release his properties confiscated during his arrest.
The evangelist Thomas Kevin Manton, of Dominion International, a church that operates from a Nairobi hotel, told chief magistrate Uniter Kidula that police are still holding his office properties which are not part of the exhibits in the case.
His plea was rejected by the trial magistrate, who directed the accused to alias with investigating officer for the alleged property since the same have not been produced in court as exhibits.
The court at the same time directed that Manton’s passport which he deposited with the court be released to him temporarily and return it back before the next hearing date.
Kevin had applied for the passport to be released to him to enable him more and visit his church outside the country.
Kevin is charged that on February 25, this year, at Runda estate in Nairobi, he made an obscene publication- a compact disc tendering to corrupt morals. He is said to have made it for the purpose of trade or for the purpose of distribution or public exhibition.
When the case came up for hearing yesterday the prosecution led by chief inspector Joseph Musyoka applied for adjournment, saying the compact disc they wanted to use in the case was still at the Criminal Investigation Department (CID) headquarters, and that investigating officer was requesting for more time to obtain the same from CID offices.
He told the court that a part of the compact disc he was ready with three witnesses who are to testifying using the compact disc. But the accused objected to the application by the prosecution for adjournment, saying police horridly arraigned him in court and they are seeking to delay the case through other means.
He told the court that the police have not yet even supply witnesses’ statements to him and asked the court to order them to be avail to him before the hearing of the case.
The magistrate directed the investigating officer to make sure the defence has all statements before the next hearing set for October 22 and 23.
