Claims of Law Sabotage Abound as Kenya Marks 47th Madaraka Day

NAIROBI,Kenya, MAY 31_Kenya marks the 47th Madaraka Day on Tuesday, June 1, 2010 amidst
rising tension in Government of National Unity led by President Kibaki
and Prime Minister Raila Odinga over the forthcoming referendum.
Claims of sabotage of the ongoing Civic education on the proposed
referendum by some Minister particularly that of Finance which is said
to have withheld funds is not working well for the Government.
Minister Uhuru Kenyatta has particularly been put on the spotlight
following the controversy over the yet to be released civic education
funds for the proposed constitution ahead of the impending referendum.
Over Ksh. 200 Million budgeted for civic education by the Committee of
Experts(CoE), has not been disbursed from the treasury and CoE officials
including Chief executive Dr. Akuru Aukot are crying foul.
Various leaders supporting the proposed constitution are doubtful of
President Kibaki’s Regime and point-men’s commitment following a
series of events that are viewed as geared towards frustrating the
review process.
Such include an illegal and mysterious insertion of the words "National Security" in the Bill of Rights Article 24(1)(d) and
subsequent halting of police investigations; failure by the Finance
Ministry to release Sh. 292 million towards the civic education
programme and High Court ruling on Kadhis' Courts.
Several leaders wonder why the President has never acted on those
involved in the clandestine activities; while taking note that all the
departments and ministries in the spotlight are under his side of the
coalition.
Finance Minister Uhuru Kenyatta who took his Yes campaigns to Murang'a
last weekend, accompanied by Vice-President Kalonzo Musyoka, remained
defiant and stated that there was no other money for civic education.
Since he attended the launch of the Yes campaigns at Uhuru Park two
weeks ago and addressed a prayer breakfast meeting at the Safari Park
Hotel last week where he vouched for the proposed laws, President
Kibaki has gone silent.
Demands for action against Uhuru and others involved in activities
viewed as geared towards sabotaging the review process continue to
heighten.
The Yes campaign team has also split with one camp coalescing around
Kalonzo and another allied to Prime Minister Raila Odinga viewing each
other with suspicions and has decided to hold separate rallies.
Many Kenyans will be waiting to hear if the President mentions
anything about the controversies and whether he would issue a sternstatement in support of the proposed laws to give the campaigns fresh
impetus.
The Prime Minister who has been on a foreign trip is expected to
attend the celebrations; so is the Vice-President, ministers and other
top Government leaders.
Some civil society groups have planned to hold demonstrations outside
the Nyayo stadium to press the Government to release the civic
education funds.
