NAIROBI, Kenya and LOWELL, Mass., _President Kibaki’s former lawyer was shot dead by police in an alleged fight over a disputed piece of land in Nairobi’s Garden estate.

Mr Anthony Nahashon Ngunjiri of A. N Ngunjiri and Advocates was killed by police bullets on Wednesday this week in a mistaken identity as he engaged a group of youth who had tried to stop him from serving them with a court order that he had obtained in favour of one party.

 The late Ngunjiri was an elder brother to Jane Elizabeth Mwangi, a Kenyan living in Lowell, Massachusetts.

   The late Ngunjiri’s death adds to two more tragedies that occurred recently in the family, which has thrown their younger sister in Boston in utter shock, leaving many wondering how one would cope with such tremendousmisery in one family within a short period of time.

 Barely one year ago in August 2010, the late Ngunjiri’s elder brother died after a long illness, prompting the sister to travel home for burial.

Nine months later, in May this year, the later Ngunjiri’s father died of a road accident just outside his gate at his home in Karatina, Nyeri district, and central province of Kenya. As a result of the sudden death, the sister was again forced to take another abrupt travel home for burial.

The impact of the husband's sudden death sent th wife (Jane’s mother) into a shock and has been hospitalized multiple times ever since.

The news of the new death has made a tragic situation even worse and has sent the ailing mother back into hospital in a serious condition.

 According to family sources who spoke to Ajabu Africa, the current death has dismayed the family leaving Jane with no option but to abruptly travel to Kenya yet again for burial .

Jane is hoping to find her mother hanging on to dear life despite her serious condition in the backdrop of the unprecedented family misery.

  The family is requesting friends and well wishers to help them with funds to travel to Kenya for burial. A prayer and an ad hoc fund raiser has been scheduled to take place at the  family’s house  located at 104 Delmont st, ( Delmon’t Gardens)  Apt 13, Lowell, Ma 01852 starting at 3.00pm.

President Kibaki’ former lawyer was shot dead by police in a fight over a disputed piece of land in Nairobi’s Garden estate.

Mr Anthony Nahashon Ngunjiri of A. N Ngunjiri and Advocates was killed by police bullets in a mistaken identity as he engaged a group of youth who had tried to stop him from serving them with a court order that he had obtained in favour of one party.

Mr Ngunjiri was the lead lawyer for President Kibaki in the 1997 presidential electionStandard petition against retired president Moi.

He was also an advocate to former MP Munene Kairu, who was a close ally of President Kibaki.

According to police, Ngunjiri had allegedly produced a gun at that moment and police had arrived at the scene when he was shot from a distance.

Police say the advocate had produced a Ceska pistol and pointed it at the group that was attacking him in the Wednesday evening incident when he was shot.

Ngunjiri was representing the family of Kairu in a land dispute case and had obtained a court order that he was serving the other party.

He allegedly went alone to the house under dispute and knocked seeking to talk to the occupants to serve them with the order.

According to Nairobistandard Area PPO Anthony Kibuchi, a group of youths came out threatening to beat him up.

"Someone called the Kasarani police station saying there was a fight involving youths and needed help because one of them had a gun," said the police boss.

Police who were patrolling the area rushed to the scene and found the group allegedly fighting. It was then one of the officers allegedly saw Ngunjiri pointing a gun at the group of youth.

Kibuchi said his officers ordered all those fighting to surrender but Ngunjiri did not prompting a shooting.

"We do not know if he was licensed to have a weapon. It is unfortunate he died but we are investigating the incident," said Kibuchi.

But Kibuchi says they are investigating to know the circumstances under which the advocate was felled.

The land in question has been under dispute for long with both parties claiming ownership. The house lying on the land was two weeks ago demolished in unclear circumstances over claims it was there illegally.

Police are interrogating a former civil servant identified as Joseph Macharia who is also involved in the tussle over the land.
